Failure to declare workers posted or the establishment of a declaration containing errors is punishable with a fine of 2.000€ to 500.000€.

Appointing a French representative

Representation contract in France

 

The French Labour Code (Article L1262-2-1) requires companies set up outside of France posting workers to French soil to designate a local representative. This service provider is in charge of acting as a liaison between labour inspection, police and gendarme services, taxes and customs. The representative maintains all of the legal documents of the foreign company, such as: the representation contract, the prior declarations of posting, the employees’ work contracts, etc.

By failing to appoint a French representative, you risk a fine from 2.000€ to 500.000€.

Managing inspections

Documents to be provided in the event of inspection

 

In the event of inspection, the company that posts one or more employees is required to provide its designated representative in the territory with certain documents.

Copy of the certificate of posting
Work or service contract
Document attesting the actual payment of salary and respect for the minimum wage
A time sheet indicating the start, end, and daily length of working time for each employee
Copy of the appointment by the employer of a representative.

When the duration of the posting is greater than or equal to one month, the company must provide the payslips or all equivalent documents proving remuneration and containing certain details.

Minimum wage, including the increases for overtime
Periods and hours of work to which the salary refers
Holidays and public holidays, and the corresponding remuneration items
Conditions subject to paid leave and bad weather, as the case may be, entitled to the applicable collective agreement
Storage and document translation

Do you post your employees to the events sector in Italy?

Prior declaration of posting

A foreign company posting personnel on Italian territory, must provide a certificate of posting for each worker it posts. This certificate of posting is to be filled out on the Italian site cliclavoro for each mission. Failure to declare to the Labour Ministry is punishable under Italian law with a fine of 150€ to 500€ per employee.

Companies set up outside of Italy post workers to Italian soil to designate a local representative (see coma 3). This person is in charge of acting as a liaison between labour inspection, the police and gendarme services, taxes and customs. The representative maintains all of the legal documents of the foreign company, such as: the representation contract, the prior declarations of posting, employees’ work contracts, etc. In addition, the representative, (see coma 4) takes part in the social dialogue, i.e., responds to the questions from unions on the company’s activity.


In the event of national non-representation, Italian law requires a fine of 2.000€ to 6.000€.
